These Terms of Service ("Terms") govern your use of Care Facility Report at carefacilityreport.com and your purchase of the report we provide (an independent nursing-home comparison built on Medicare's CMS Care Compare data). By using this site or buying a report, you agree to these Terms.

1. What you are buying

Care Facility Report sells a one-time informational report for $19. The report gathers the Medicare-certified nursing homes near the ZIP you supply and compares them on the CMS Care Compare ratings, staffing hours, fines, and abuse flags that CMS publishes.

2. The report is an informational estimate, not professional or medical advice

The report is provided for general informational purposes only. It organizes public CMS data and is not a professional service, a medical opinion, a placement recommendation, or a substitute for your own in-person visit and judgment. It does not create any professional-client relationship. It is not medical, legal, financial, or care-placement advice, and it is not an endorsement or a warning about any specific facility. You are solely responsible for any decision you make about care, and you should visit any home in person and consult appropriately qualified professionals before acting on anything in the report.

3. No warranty

The report and this site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The report draws on public CMS Care Compare data that CMS updates on a quarterly cycle and that may contain errors, gaps, or figures that lag real changes at a home. We do not warrant that the report is accurate, complete, current, or fit for any particular purpose.

4. Limitation of liability

To the maximum extent permitted by law, Care Facility Report, its operators, and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or the report. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the report or these Terms will not exceed the amount you paid for the report ($19).

5. Refunds

We check that Medicare-certified homes exist near your ZIP before you are charged, so you will not pay for an empty report. Because the report is a digital product delivered immediately, refunds are provided for delivery failure: for example, if you paid but did not receive your report, or the report could not be generated. If your report failed to arrive or cannot be produced, email [email protected] and we will re-deliver it or refund your purchase. If you believe a specific figure in your report is wrong, contact us; we will investigate and, where a delivery or generation fault is on our side, make it right.

6. Acceptable use

You agree not to: resell, republish, or redistribute the report as your own product; scrape, bulk-download, or systematically extract content from the site; attempt to disrupt, overload, or gain unauthorized access to the site or its infrastructure; or use the site or report for any unlawful purpose. The report is licensed to you for your own personal or family use.

7. Intellectual property

The site, its design, its text, and the report format are owned by Care Facility Report and protected by intellectual-property laws. The underlying CMS Care Compare data referenced in the report belongs to its respective public sources. We grant you a limited, non-exclusive, non-transferable license to use the report you purchase for your own purposes.

8. Not affiliated with CMS or Medicare

Care Facility Report is an independent tool. We are not affiliated with, endorsed by, or operated by the Centers for Medicare & Medicaid Services (CMS) or Medicare. "Medicare", "Care Compare", and related marks belong to their respective owners and are used here only to describe the public data the report is built on.

9. Third-party services

Payments are processed by Stripe under Stripe's terms. Analytics are provided by Fathom Analytics. We are not responsible for the practices of third-party services, though we choose them with your privacy in mind (see our Privacy Policy).

10. Governing law

These Terms are governed by the laws of the United States and, to the extent applicable, the state in which the operator of Care Facility Report is established, without regard to conflict-of-laws rules. You agree that any dispute will be brought in the courts located there.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the site after changes take effect constitutes acceptance of the revised Terms.
